About these terms

These terms are an agreement between you and Bagged Comics (ABN 92 548 131 715), trading as Bagged Comics ("we", "us"). They apply when you join our waitlist, create an account, or buy from us. You agree to them when you tick the box at sign-up. Please read them with our Privacy Policy.

Your rights under the Australian Consumer Law. Our goods and services come with guarantees that can't be excluded under the Australian Consumer Law. For major failures with the service, you're entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You're also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service doesn't amount to a major failure, you're entitled to have the failure rectified in a reasonable time. If this is not done you're entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You're also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service. Nothing in these terms limits those rights.

How Bagged works

  1. You subscribe to series, and we add each new issue to your pull list. You can also add single comics, and items from our Store.
  2. You can change or skip anything on your pull list until its lock time, shown next to each comic. Most comics lock together once a month, a few days before our distributor's order deadline. Some comics have their own lock time, which we show.
  3. At the lock time we charge your card for everything that locks then, and order it from the distributor.
  4. When the comics arrive on their release dates, we bag and board them, and they wait in your box.
  5. We ship your box on your plan's dispatch day: every Friday on the Weekly box, or the last Friday of the month on the Monthly box. Your first box goes out as soon as your first comics are ready. If a dispatch day is a public holiday, we ship the business day before.

Your account

  • You must be 18 or over and live in Australia to create an account. You confirm you're 18 or over when you sign up. We only deliver to Australian addresses.
  • One account per person. Keep your details, especially your email address and delivery address, up to date.
  • You sign in with a link we email you, or a passkey. A link only works in the browser that asked for it. Anyone who can read your email may be able to get into your account, so keep your email account secure. Tell us straight away if you think someone else has used your account.
  • You're responsible for orders placed on your account.

Membership

  • Plans. The Monthly box and the Weekly box each have a monthly membership fee, shown on our website, when you choose a plan, and when you save your card. The Weekly box costs more because we ship more often.
  • When the fee starts. We don't charge anything when you sign up. Your first membership fee is charged with your first order that has comics in it. After that it's charged monthly on that day of the month: with an order if one is due within a few days, otherwise on its own.
  • Founders. Our first 100 members get 10% off their membership fee. You hold a founder place from sign-up, and secure it, with your founder number, by paying for your first order within the time we tell you when you join. A place not secured in time goes to someone else. Once you have a founder number, the founder discount stays with your account, even if you pause, cancel and rejoin. The discount you're given with your place doesn't change if we later change the founder discount for new founders.
  • Specials and coupons. We sometimes offer limited-time specials on a plan, such as a lower fee for your first few months, a minimum discount on your orders, welcome credit, or cheaper postage on your first shipments. You get a special if you sign up for that plan before it ends, and its conditions are shown when you sign up. Coupons have their own conditions, shown when you use them. Each person can use a coupon or special once. If a founder discount, coupon and special apply to the same fee, you get whichever is bigger, not all of them.
  • Bagged Bucks. Some of our plans offer "Bagged Bucks" which are store credits which can only be used within our "Store" (i.e. not our Pull List). Bagged Bucks have an expiry of 90 days, and can be spent in our store where you can find items such as hobby supplies (bags, boards, boxes), or back issues or special variants. This is different to Account Credits which can be spent across Bagged Comics.
  • Account Credits. We may sometimes offer Account Credits (for example, our Referrals). Account Credits can be spent across Bagged Comics, including on Pull List orders or across the Store. Account Credits can have an expiry associated with them.
  • Pause. You can pause your membership in Account. While it's paused, we don't charge membership fees, and comics that reach their lock time aren't ordered for you.
  • Cancel. You can cancel at any time in Account. Cancelling stops membership fees and new orders straight away. Comics already locked or paid for will still be shipped, and you'll pay postage for them. We don't refund the part of a month's fee you've already paid, unless the law requires it.
  • Changes to fees. We may change membership fees. If your fee goes up, we'll email you at least 30 days before you first pay the new fee, and you can change plan or cancel before then.

Prices and payment

  • Prices are in Australian dollars and include GST.
  • The price you pay for a comic is its price when it locks. Until then, its price can change, for example if the distributor changes its cover price. If the price of a comic on your pull list goes up before it locks, we'll email you with the old and new price, so you can skip it. If it locks within 48 hours of the rise, you pay the old price. If a price goes down, you pay the lower price.
  • Discounts. The more your order adds up to when it locks, the bigger the discount, using the spend tiers shown on our website. Tier discounts apply to comics, and to Store items added to your box unless the item says otherwise. They don't apply to membership fees, postage, or Store items you ship straight away. If we change the tiers so that some orders get less off, we'll email you at least 30 days before, unless we need to make an emergency change to the pricing (such as an administrative error), and orders that lock before then keep the current tiers. Changes that only give you more off apply straight away.
  • Postage. Each box, and each Store order you ship straight away, has one postage price, based on its weight. It covers postage, packaging and handling. You choose standard or express (which costs more), for each box or as your usual choice. You see the price in your cart and on My box before your box ships, and we charge it when it ships.
  • Your card. When you save a card, you authorise us to charge it, without asking you each time, for: your comics and Store items when they lock, your membership fees when they're due, postage when your box ships, and any amount you owe us. We show you exactly what you're agreeing to when you save it. Store orders you ship straight away are charged when you check out. Charges are processed by Stripe. If your bank asks you to approve a payment, we'll email you a link.
  • Failed payments. If a payment fails, we'll email you and try again on a set schedule. If an order still isn't paid shortly before we must order its comics from the distributor, we cancel it and release those comics. If 2 orders in a row are cancelled this way, your membership pauses until you add a working card.
  • Money owing. If you owe us for postage or membership fees, we hold your box until it's paid. You can pay from Billing.
  • Tax invoices are in Billing for every charge. If the price of something on an invoice later goes down (a refund, Account Credit for a comic we couldn't supply, a cancelled Store order, or an unpaid order we cancelled), the invoice stays as it was and we issue an adjustment note for the difference, also in Billing.

Pre-orders and availability

We pre-order comics from distributors before they're printed, so availability is never guaranteed:

  • Cancelled or delayed comics. Publishers and distributors sometimes delay, change or cancel comics. If a comic you've paid for is cancelled, we credit what you paid to your account as Account Credit. If you'd rather have the money back on your card, ask us and we'll refund it.
  • Short supply. Sometimes we receive fewer copies than we ordered, or copies arrive damaged. When that happens, we decide who gets the copies we have using the rule in our Privacy Policy (under Automated decisions). If you miss out, we'll email you and credit what you paid as Account Credit, used on your next charges. If you'd rather have the money back on your card, ask us and we'll refund it.
  • Comics not available in Australia. Some comics can only be sold in certain countries. We hide those, and cancel any requests for them before they lock.
  • Variant and incentive covers that distributors only supply as a ratio of other orders can't be pre-ordered.
  • Payments that arrive too late. If a payment goes through after we've had to cancel the order, we keep it as Account Credit, and we'll refund it to your card when you ask.

The Store

  • The Store sells supplies, trades, starter kits and back issues. You can ship an order now, or add items to your box so they lock with your next monthly lock and ship with your box.
  • Ship now: we charge your card when you check out, and post the order separately. You can cancel it until we've started processing it (picked it for packing, or ordered it from the distributor), and we'll refund it to your card.
  • If an item we thought we had in stock isn't there, we'll email you. You can wait for it or cancel it for a refund. If we've had to reorder it from the distributor, we'll tell you it's delayed.
  • Back issues are second-hand unless the listing says New. A second-hand copy's listing shows its condition (from Near Mint to Poor, using our grading). Graded copies show the grading company, grade and certificate number: that's the grading company's assessment, and we haven't re-graded them. A copy will match the condition we describe.

Mature-reader titles

Some titles are for mature readers. They're hidden until you turn on Show mature-reader titles in Account or when you choose your series.

Delivery

  • We ship each box and Store order by Australia Post or another carrier, to the address in your account when it ships. We give the carrier your name, address, email and phone number so it can deliver the parcel and send you tracking updates, as our Privacy Policy explains. We email you a tracking link for each parcel.
  • Estimated delivery dates are estimates. Distributor delays, public holidays and postal delays can change them.
  • If your parcel is lost or arrives damaged, contact us and we'll work it out with Australia Post, then replace or refund. The risk of loss stays with us until the parcel is delivered to your address.
  • If a parcel is returned to us because the address was wrong or it wasn't collected, we'll contact you. We may charge you postage to send it again.
  • Ship early. You can ask us to ship your box early. It goes out on the next dispatch day, and you pay postage for it.

Problems with your order and returns

  • Report it online. If a comic or Store item arrives damaged or faulty, or isn't what you ordered, go to Orders, open the delivery and choose Have an issue with this delivery? within 10 days of delivery. Tell us what's wrong and add photos. After that, or if you'd rather, contact us at support@baggedcomics.com.au: your rights under the Australian Consumer Law don't end after 10 days.
  • We'll reply within 2 business days] and, for each copy, either:
  • ask you to send it back with the RMA slip we give you. We pay return postage for items that are damaged, faulty or not what you ordered: we'll usually give you a prepaid label. If we don't, post it with a tracked service and keep the receipt, and we'll pay back your postage with the refund. Please send it within the time on the RMA. If you can't, contact us: the return can still be sorted out after that date;
  • ask you to destroy it and send us a photo that shows it's destroyed; or
  • explain why we don't think there's a problem. If you disagree, reply to our email and we'll look again. Your rights under the Australian Consumer Law don't end with our decision, and you can contact your state's fair trading agency (see Contact and complaints).
  • Once we've received the copy or the photo, and checked it matches your report, we refund it to your card or as Account Credit. If we give you Account Credit and you'd rather have the money on your card, ask us.
  • If the copy we get back doesn't match your report, for example it isn't the copy we sent, it doesn't have the problem you described, or it's been damaged since it was delivered, we may decline to refund it. We'll email you to say why, and hold the copy for you for 60 days. If you'd like it back, contact us and we'll post it to you at your cost (we'll tell you the price first). If you think we've got it wrong, contact us. This doesn't limit your rights under the Australian Consumer Law: if the copy is faulty, we'll still put it right.
  • Change of mind. Because comics are pre-ordered for you, we don't accept change-of-mind returns once a comic has locked. You can change or skip anything on your pull list until it locks, and cancel a Store "ship now" order until we start processing it. We also cannot accept change-of-mind returns on Store items.
  • Disputing a charge. Please contact us before disputing a charge with your bank; we can usually sort it out faster. While a card dispute is open, we hold your box.

Account credit

  • Account credit comes from comics we couldn't supply, payments we couldn't use, refunds, goodwill, and promotions.
  • It's applied automatically to your next charges.
  • Credit from comics we couldn't supply, payments we couldn't use, or refunds is your money: it doesn't expire, and we'll refund it to your card when you ask.
  • Promotional credit (from a coupon, a special, or a goodwill gesture) has no cash value, can't be refunded, and may expire, as shown when we give it.

Closing your account

  • You can delete your account in Account → Delete your account. You'll need to wait until any comics you've paid for or that have locked have shipped, any money owing is paid, and any open returns are resolved.
  • If you have Account Credit that's your money, it's refunded to your card before your account is deleted: Account offers the refund right there. Promotional, goodwill credit, and Bagged Bucks are forfeited when you delete your account.
  • Accounts nobody uses. If your membership is cancelled and there have been no orders, payments or sign-ins for 3 years, we close your account the same way, as long as nothing would stop you deleting it (Account Credit that's your money keeps it open). Signing in at any time before then keeps it.
  • Our Privacy Policy explains what we delete and what we must keep.

The waitlist

  • Joining the waitlist doesn't create an account or commit you to anything. We'll only email you about our launch.
  • Your place depends on when you confirmed your email address, and how many confirmed people joined with your share link. We can change how places are worked out, or remove entries we think are fake or made automatically.
  • A place on the waitlist doesn't guarantee a founder place or any other offer. Founder places go to the first members to sign up once we launch.

Using our website

  • Don't misuse the site: no scraping, automated sign-ups, breaking security, or reselling access.
  • The comic covers, descriptions and other content on the site belong to their publishers, creators and other owners. Some series information comes from Metron. Our own content, design and name belong to us.
  • We may suspend or close an account that breaks these terms, is used for fraud, or abuses our staff. If we close your account, we'll ship anything you've paid for or refund it, and refund any Account Credit that's your money.
  • We try to keep the site available but may need to take it down for maintenance. If an outage stops you from changing your pull list before a lock, contact us.

Our liability

Apart from your rights under the Australian Consumer Law and any other law that can't be excluded, we're not liable for loss that isn't reasonably foreseeable, or that's caused by something beyond our reasonable control, such as a publisher cancelling a comic or a postal strike.

Changes to these terms

We may update these terms, for example when we add a feature or the law changes.

  • Minor changes (a typo, a new address) apply when we publish them.
  • Other changes: we'll email you at least 30 days before they take effect, with a summary of what's changing. Once they take effect, we'll ask you to agree to them when you next visit. If you don't agree, you can cancel your membership. If you continue to use the site and place orders following this advance notice, you agree to the new Terms and Conditions.

The date at the top shows the latest version, and we keep every version.

Contact and complaints

Email us at support@baggedcomics.com.au. If we can't resolve a problem, you can contact your state's fair trading agency.
